All services are provided based on mutually agreed terms outlined in individual project contracts.

3. Intellectual Property

All content on this website, including text, graphics, logos, images, and software, is the property of Perfakt Consultants and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

Project-specific deliverables, including plant designs, process flows, and technical documents, remain the intellectual property of Perfakt Consultants until full payment is received, after which ownership transfers to the client as specified in the project agreement.

4. Client Responsibilities

When engaging our services, clients are responsible for:

• Providing accurate and complete information about their requirements
• Ensuring timely access to project sites when required
• Obtaining necessary permits and approvals from local authorities
• Making payments as per the agreed schedule
• Reviewing and providing feedback on deliverables within agreed timelines

5. Confidentiality

We maintain strict confidentiality regarding all client information, project details, and proprietary data shared with us. Our team members are bound by confidentiality agreements, and we implement appropriate security measures to protect sensitive information.

6. Limitation of Liability

While we strive to provide accurate and reliable consulting services, Perfakt Consultants shall not be liable for:

• Indirect, incidental, or consequential damages arising from our services
• Delays caused by factors beyond our control
• Issues arising from client's failure to follow our recommendations
• Third-party equipment or service failures

Our maximum liability shall be limited to the fees paid for the specific service in question.

7. Payment Terms

Payment terms are specified in individual project agreements. Generally:

• An advance payment is required before project commencement
• Progress payments are due as per agreed milestones
• Final payment is due upon project completion
• Late payments may incur interest charges as specified in the agreement

8. Termination

Either party may terminate a project agreement with written notice as per the terms specified in the agreement. In case of termination:

• Payment for work completed up to the termination date shall be due
• All deliverables completed shall be handed over upon payment
• Confidentiality obligations shall survive termination

9. Dispute Resolution

Any disputes arising from our services shall be resolved through:

• Good faith negotiations between the parties
• Mediation by a mutually agreed mediator if negotiations fail
• Arbitration under the Arbitration and Conciliation Act, 1996, if mediation fails

The courts of Gujarat, India shall have exclusive jurisdiction over any legal proceedings.
